The shortcomings of the transparència state

transparencyThe president of Council for Transparency and Good Governance, Esther Arizmendi, has highlighted, in a interview published in the newspaper El Pais , the important obstacles to the performance of their duties.

Arizmendi laments both the lack of resources and the lack of support and interest from the state government. He attributes the lack of publicity to the limited impact that the implementation of the measures has had. transparència has had so far in the citizenship.

Added to this is the fact that the request for access to information is dissuasive as it requires a digital certificate or a complicated key system that requires prior registration with personal data (including account number) and, above all, the lack of a sanctioning regime that reinforces the Council's action in ensuring compliance with the law.

This situation contrasts sharply with the measures taken in Catalonia where, according to the interviewee, there is much more open and advanced legislation.

In this sense, it should be noted that the Catalan Ombudsman, the Catalan Audit Office, the Anti-Fraud Office of Catalonia and the Commission for the Guarantee of the Right of Access to Public Information are the bodies that ensure compliance with the obligations and rights established in Law 19/2014, of 29 December transparència, access to public information and good governance, which, contrary to what happens at the state level, does have a sanctioning regime in its Chapter II.
