Three studies published on the European AI Law

La Artificial Intelligence Law (AI) drives the creation of a European single market based on trustworthy, people-centric AI. Its aim is to foster innovation and adoption of these technologies, while ensuring a high level of protection of health, safety and fundamental rights, including democracy and the rule of law.

Within this framework, Article 5 establishes the prohibition of certain particularly harmful and abusive AI practices, which violate essential values of the European Union such as human dignity, freedom, equality and fundamental rights.

Three studies analyze in depth different aspects of this article:

Un report prepared for the European Commission on article 5.1, sections a) and b), which examines issues such as harmful manipulation, deception and exploitation, according to Dr. MR Leiser.
Un study on the prohibitions included in sections 5.1(c) (social scoring), 5.1(d) (predictive surveillance), 5.1(f) (emotion recognition) and 5.1(g) (biometric categorization), as well as the procedural requirements for exceptions in real-time remote biometric identification, developed by EJ Kindt.
Un Catherine Jasserand's report focusing on the prohibition of Article 5.1(h) and its three exceptions, as well as in the requirements for untargeted extraction of facial images and real-time biometric identification.

These three expert studies are among several sources that the European Commission has taken into account in developing the guidelines on prohibited practices. The process has also incorporated input from a public consultation, contributions from Member States through the AI Council and opinions from the European Parliament.
