The new website of the Commission for the Guarantee of the Right of Access to Public Information (GAIP) has published the list of resolutions which has so far ruled on the right of access to public information since the entry into force of the Law 19/2014, of December 29, of transparència, access to public information and good governance.
The GAIP is the independent guarantee body to which the public can claim if an administration of Catalonia, or any public body, organism or company that depends on it, does not facilitate access to public information that has been requested.
The claim procedure before the GAIP is fast (two months) and free. To file a claim you must fill out a simple form that is available at GAIP website.
On the other hand, Law 19/2014, provides in a unique and differentiated way for Catalonia the possibility that the person who claims against an administration can request a mediation procedure, supervised by the GAIP, for the speedy and agreed resolution between the parties. If within one month the parties do not reach an agreement, the GAIP resolves on the merits of the claim.
