The comprehensive adaptation of the legal framework regarding the protection of whistleblowers (which should entail legislative reforms in the criminal, procedural and labor order, among others, in addition to laws ) becomes central. It is necessary, however, that the regulatory reforms are accompanied by actions aimed at a deeper and lasting cultural and mentality change, which will eliminate the negative perceptions that still linger and provide confidence to the potential whistleblower.
On the other hand, a good alert system does not end with the implementation of a reporting channel and the approval of a protection protocol. The importance of other structural elements that must be acted upon, to the extent that they condition the potential whistleblower, must not be underestimated. With a good policy of transparència or human resources management, for example, obstacles that hold back the person reporting due to finding themselves in a position of weakness or uncertainty can be removed. On the other hand, there are organizational aspects that favor silence and complicity.
Likewise, a general reflection is needed to transform the collective view and conceive the alert as a civic and responsible act, not as disloyalty or betrayal.
Targets:
- Discern, conceptually, what it means to have complaint channels, ethical mailboxes and the function of legal advice.
- Provide an applied analysis of European regulations and their transposition, with attention to complex aspects such as the coexistence between reporting channels, ethical mailboxes and the function of legal advice.
- Identify the main challenges for the management of alert/complaint channels and establish the criteria to do so effectively.
- Reflect on the different measures to comprehensively protect whistleblowers in accordance with current regulations.
