How to make good use of Via Oberta (XI): traceability and security in the management of citizens' right of access

In certain cases, especially following complaints to the Catalan Data Protection Authority (APDCAT) or the exercise of the right of access by citizens, public bodies may need to know which queries have been made about a specific citizen through Via Oberta. 

To guarantee adequate, traceable management aligned with data protection regulations, it is important to process requests necessarily through the channel EACAT, through a generic deliveryThis procedure allows: 

  • Dispose of a official registration entrance. 
  • Guarantee management formal and traceable of the information. 
  • Give an answer for the same way, leaving a record of the entire process. 

In addition, to facilitate correct processing of the request, the submission must include the following information: 

  • Identification of the person interessada: DNI/NIE or complete identification data 
  • Request context: Reason for the request (for example: right of access exercised by the citizen or request from the APDCAT). 
  • Dimension data: Any other relevant information that allows you to narrow down the search (approximate dates of the query, associated procedure or purpose, etc.). 

The use of this procedure contributes to strengthening the transparència, security and traceability in information management, key aspects in compliance with current regulations.
