The Technical Secretariat of the Public Procurement Advisory Board made available to the contracting bodies of Catalonia, in October 2023, the Recommendations and good practices document in the use of the Public Procurement Services Platform (PSCP) and the eLicita tools, which highlights aspects to take into account to guarantee the rigor of the data and compliance with the guiding principles of contracting, highlighting transparency, equal treatment and public access to information.
This May, the document has been updated by the same competent body, to include the aspects detailed below:
– A section is added regarding the publicity and transparency of the opening of the envelopes containing the bids. Specifically, it is noted that, in order to comply with the principles of publicity and transparency –and given that when using electronic means in public procurement procedures, it is not required to open the envelopes containing the bids in a public event–, The opening record generated by the Digital Envelope tool with the traces of the actions taken to open the bids must be included in the minutes of the meetings published in the PSCP., which guarantee the secrecy of the offers until the moment of opening, in accordance with the fifteenth additional provision of Law 9/2017, of November 8, on public sector contracts.
– In the section relating to the setting of deadlines for submitting bids, It is remembered that if the deadlines are set in calendar days, to provide for this in a law –as is the case with the twelfth additional provision of the LCSP– or European Union law, this circumstance must be stated in the corresponding notifications, in accordance with article 30.2 of Law 39/2015, of October 1, on the common administrative procedure of public administrations.
