The Constitutional Court admits the proceedings for unconstitutionality against the new administrative laws

On post published last June 15th we announced that the Government of the Generalitat had agreed to challenge some articles of Law 39/2015 and Law 40/2015, the so-called new administrative laws.

In the BOE of 1 August the admission for processing by the TC of the corresponding appeals of unconstitutionality presented by the Government of the Generalitat, no. 3628-2016 and 3774-2016 corresponding to the aforementioned laws respectively, has been published.

This challenge does not interfere with the entry into force of the laws, as the suspension is a power that can only be exercised by the President of the Spanish Government in the face of the challenge of regional laws.
