New extension of the mandatory implementation of e-government
The Court of Justice of the European Union has declared invalid the Commission Decision approving the Safe Harbor Agreement with the United States. This Agreement granted the affiliated American companies a level of protection comparable to a European company. This allowed, in an easy and agile way, to be able to operate with personal data of Europeans in these American companies. This decision of the ECJ implies:
- Data transfers to the United States will be made to a country without the level of protection that Europe enjoys
- The consent of the data holders to be processed in the United States must be collected, or
- Apply for authorization from the Spanish Data Protection Agency.
