The EU Court of Justice overturns the Safe Harbor Agreement on the level of data protection in the United States

The Court of Justice of the European Union has declared invàlidto the Commission Decision that approved the Safe Harbor Agreement with the United States. This Agreement granted American companies that joined it a level of protection comparable to a European company. This allowed, in an easy and agile way, to operate with the personal data of Europeans in these American companies. This decision of the CJEU implies:

  1. Data transfers to the United States will be made to a country without the level of protection that Europe enjoys
  2. The consent of the data holders to be processed in the United States must be collected, or
  3. Apply for authorization from the Spanish Data Protection Agency.
