To promote Smart Administrations, access to data with public value from the private sector is necessary.
The Ombudsman, who by virtue of the Law 19/2014, of December 29, on transparency, access to public information and good governance, is responsible for assessing compliance with this Law, has entrusted to the Pi i Sunyer Foundation the accomplishment of the field work for the preparation of theevaluation report on compliance with the Transparency Law.
Thus, according to article 92 of the said Law, the competence to evaluate compliance with this law falls to the Catalan Ombudsman, who must establish the objective indicators that must be used as a reference to carry out the evaluation task.
In this regard, in accordance with article 93, the Catalan Ombudsman must prepare and submit to the Parliament a general evaluation report on the application of this law, and the authorities and staff at the service of administrations, entities and agencies within the scope of this law have a duty to collaborate with the Catalan Ombudsman in the preparation of evaluation reports.
For this reason, the Catalan Ombudsman has recently sent letters to entities under the Act informing them that the Pi i Sunyer Foundation will begin the base camp work for the preparation of the report and ask them for maximum collaboration.
The report will be made based on the analysis of the municipal websites on the one hand, and the answer to a questionnaire that will be sent to the local authorities and that they will have to fill and send on the other.
So far, the objective indicators that should serve as a reference to carry out the evaluation task have not been made public, but we understand that compliance with the transparency inventory carried out by the Transparency Governments Network working group of Catalonia guarantees compliance with the Law of Transparency of Catalonia.
