Through Via Oberta, the AOC Consortium facilitates the telematic exchange of data and documents necessary for administrative processing between administrations and public entities, in order to facilitate the right of citizens not to provide documents that are already in their possession. administrations (right recognized in article 6.2 b of Law 11/2007, on electronic access of citizens to public services and article 25.4 of Law 26/2010, on the legal and procedural regime of the public administrations of Catalonia ).
In addition, in accordance with the administrative simplification measures regulated in Chapter III of Law 26/2010, on the legal and procedural regime of Catalan public administrations, the presentation of the “Responsible Declaration” within the framework of an administrative procedure and the “Communication prior to the exercise of a right or the start of an activity, authorizes the corresponding public administration to verify the conformity of the data contained therein.
On the other hand, art. 22 of Law 29/2010, of 3 August, on the use of electronic media in the public sector of Catalonia, establishes that:
“The Electronic Open Administration Consortium of Catalonia, in order to make effective the interoperability between the applications and the information systems used by the entities that make up the public sector of Catalonia, may have access to data from files or data processing of the entities, if the access is necessary to provide the services established by this law.
The Consorci Administració Oberta Electrònica de Catalunya, in the processing of personal data that must be carried out on behalf of the entities that make up the public sector of Catalonia, both with respect to the entities that make certain information available electronically and with respect to who are interested in accessing it, is in charge of this treatment, must apply the required security measures and it is subject to the instructions given by the entity responsible for the information, without being able to use the information for different purposes to those established by the responsible entity, nor allow access to information to persons or entities that do not meet the legally required requirements. It is also subject to the other requirements established by the regulations for the protection of personal data ”.
