On May 24, 2013 the Council of Ministers received a report on this Bill. It is a comprehensive and complete law, which encompasses the tasks of all ministerial departments, which aims to facilitate all entrepreneurial and business activity: from the establishment of companies and their tax regime, to support financing and the need for to make the relationship between companies and AAPPs more fluid, according to La Moncloa.
We highlight some points,
"MEASURES TO ENCOURAGE BUSINESS GROWTH."Reduction of administrative burdens
- in labor matters, the obligation for companies to have, in each work center, a guest book available to Labor Inspection officials is eliminated. The Labor Inspectorate will be responsible for maintaining this information by telematic means.
- opens the possibility that the employers telematically legalize their books in the Mercantile Registry.
- the Law on Urgent Trade Liberalization Measures and Certain Services, of December 26, 2012, is amended to extend the maximum area threshold of establishments that will be exempt from municipal license, as well as expanding the list of activities exempt from applying for a municipal license.
- in matters of public procurement, the following forecasts: raising the thresholds for the classification requirement in works contracts (rising by 150.000 euros, from 350.000 euros to 500.000 euros) and services (rising by 80.000 euros, from 120.000 to 200.000 euros); forecast that the guarantee in the works contracts can be constituted by means of retention in the price and reduction of the terms for the return of guarantees (from twelve months to six months in the event that the winning company is an SME); reduction from eight to six months of the delay period to request the termination of the contract in the event that the awarded company is an SME; and inclusion of a new article to establish greater control over the payments contracted contractors must make to subcontractors.
- new visa regime and residence permits for highly qualified investors, entrepreneurs and professionals, and for intra-business mobility.
- The impetus for the Emprende en 3 project: "is a telematic processing system for the establishment and start-up of a business activity. It is a platform developed with the participation of the General Administration of the State, the Autonomous Communities and the Local Entities, representagiven by the Spanish Federation of Municipalities and Provinces”.
The platform allows to carry out the necessary procedures with the 3 Administrations at the same time, because the system sends the responsible declarations to the City councils.
