The TC declares an article of the Local Scheme Law unconstitutional and invalid

 The Plenary Session of the Constitutional Court has issued the “Judgment 103/2013, of April 25, 2013. Appeal of unconstitutionality 1523-2004“, Filed by the Parliament of Catalonia in relation to various precepts of Law 57/2003, of 16 December, on measures for the modernization of Local Government.

It has declared unconstitutional and null, in the terms established in its legal basis 6 of the Judgment, paragraph “The Mayor may appoint as members of the Local Government Board persons who do not hold the status of councilors, provided that their number does not exceed one third of their members, excluding the Mayor”, from paragraph second, of article 126.2 of Law 7/1985, regulating the bases of local regime, in the wording given to the same by the first article of Law 57/2003, of December 16, of measures for the modernization of local government.
