Section 1.f) of the Sixteenth Additional Provision of the Revised Text of the Public Sector Contracts Act approved by Royal Legislative Decree 3/2011, of 14 November, establishes that all acts and expressions of will of the administrative bodies or of the bidding companies or contractors that have legal effects and are carried out throughout the contracting procedure must be authenticated by a recognized electronic signature.
The Identity working group proposed to address the possibility of raising a proposal for a change in the requirement for an electronic signature recognized by an advanced electronic signature. The proposal obtained the majority support of the working group and it was decided that it would be formalized in writing to the Ministry of Finance and Public Administrations with the following motivations:
- requests from companies to use the same certificates that are used in the relationship with the AEAT and the TGSS
- requests from Public Administrations to facilitate the use of electronic tenders
- principle of proportionality between usability and security
