Access to public information: a fundamental right of citizenship
With the new version of e-TRAM that is being worked on, we will also increase the possibility of having new citizen procedures. We are currently working on the procedures associated with Access, Rectification, Cancellation and Opposition, the so-called ARCO Procedures, which, with specific forms, improve the management that is currently being done in many municipalities of the aspects associated with the LOPD ( Organic Law on Data Protection), where until now it can only be exercised in person or electronically through the generic instance.
So the Access procedure it will allow citizens to request and obtain information on whether their personal data is being processed, for what purpose and what specific uses, where it was taken from, whether it was communicated or intended to be communicated and to whom.
El Rectification procedure, will allow to rectify the personal data that appear in the data files of the City council when they are erroneous or incomplete.
El Cancellation procedure, will allow the deletion of personal data when they are inappropriate, excessive or unnecessary, or when they are kept for a longer period than appropriate, or are contrary to the LOPD.
Finally, the Opposition procedure will allow requests for personal data not to be processed when:
1) consent is not required to process the data as long as there is no legitimate reason for a specific personal situation and no law says otherwise.
2) in the case of files for advertising and commercial prospecting purposes
For all these new procedures, citizen authentication will be proposed by means of a digital certificate, and they will be available in the new catalog once the new version of the platform is up and running.
